1. Can I hold Real Estate in an IRA account?
Yes!
2. What type of Real Estate can be held inside an IRA?
Almost any type, Income producing Real Estate, Undeveloped Land, Agricultural Land, etc.
3. Must the Real Estate be in my State?
There is no restriction on the location of the real estate, it may even be in a foreign country.
4. Can my IRA partner with another person or IRA account to buy property?

5. May my spouse and I invest in the same property?

6. If my IRA buys undeveloped land for $45,000 and later sells the land for $100,000 how much income tax will I need to pay when the land is sold?
Zero: all earnings made by an IRA are tax deferred until you decide to take a distribution. If you hold the asset in a Roth IRA the earnings are totally tax free.
7. What type of Self Directed IRA is best for holding Real Estate?
Real Estate can be placed in any type of self directed IRA account. However, The IRA Club suggests that you consider using a Checkbook IRA. This allows you to have check writing control and can save you time and money in the future.
8. Can my IRA borrow money to buy Real Estate?
Yes, however there are two considerations:
1. The loan must be Non-recourse.
2. While the loan is outstanding your IRA must annually file an IRS Form 990T
3. Your IRA may be required to pay “Unrelated Business Income Tax” on the earnings generated by the amount of borrowed money used by the IRA.
9. If my IRA buys a house or condo and after a period of time (maybe 10 years) I want to move into that house, what do I do?
This is a Distribution. In this case instead of ditributing dollars to you, the IRA would distribute Real Estate.
10. I already own Real Estate, can I sell it to my IRA?
Sorry, no. Your IRA may not buy from you.
11. If I buy Real Estate costing $20,000 in my ROTH IRA and at some time in the future am able to sell it for $200,000 it sounds like all the earnings will be tax free when I take my IRA Distribution. That sounds too good to be true!
I agree with you however, that is exactly how the tax code is written. You are correct, all the earnings will be tax free.
12. Can my Self Directed Real Estate IRA buy a house and rent that ouse to my daughter? She will sign a lease and pay rent.

13. I want to use my Real Estate IRA money to buy a Christmas Tree Farm in Northern Michigan. There is a company that will come in and harvest some fo the mature trees each year. I think the land will be valuable someday but until then harvesting the trees seems like a good idea. Would this be OK for a Real Estate IRA? real estate ira
Yes, just allow someone other than yourself to harvest the trees. The money they pay to your IRA can be used to cover the property taxes and anyother expenses. The earnings will be tax deferred for as long as you leave your funds inside the IRA. real estate ira
14. I want to buy a Condo in Miami using my IRA funds. There is a management company that will lease it for two weeks at a time to tourists and maintain the place. They tell me I can earn a 15% return plus enjoy the benefit of the appreciation when it goes up in value. They said I can use the place myself up to 14 night a year. Is that right? real estate ira
NO. Making the investment is your choice, however you may not use the condo for yourself or a family member even one night a year. Real Estate IRAs (as with all IRAs) are for your future benefit (not your current benefit).
15. All the examples I read about Real Estate IRAs refers to residential property. May my IRA invest in commercial property?
Yes, an IRA may invest in any type of Real Estate.
